It looks like good news for Kim Kardashian and Kanye West after the California appeals court authorized the couple to sue former YouTube chief executive for leaking video footage of West's 2013 proposal to Kardashian.
Kim Kardashian and Kanye West have been authorized to proceed with their lawsuit against YouTube's co-founder Chad Hurley, a California appeals court ruled April 22. Kimye's lawsuit against Hurley over leaked footage of their marriage proposal will apparently move forward, Billboard noted.
According to a three-justice panel of the 2nd District Court of Appeal in Los Angeles, Kardashian and beau West seem confident of winning the legal battle against Chad Hurley, who posted footage of the famous couple's elaborate marriage proposal two years ago on his then-new website, MixBit, despite having a confidentiality agreement in place.
An AssociatePress report claim that the leak appeared before the proposal aired on "Keeping Up With The Kardashians."
Hurley, on the other hand, argued that the confidentiality agreement he signed was not binding on MixBit; the court, however, said that the altercation lacked a strong point. According to the reality star and her husband, Hurley approached unnoticed into AT&T Park with the motive of filming the proposal, and they allowed him stay on the property after he signed a non-disclosure agreement.
Infact, RollingStone noted that Hurley was even photographed holding that document.
The pair claimed in their lawsuit that Hurley continued to try to convert the event into one starring himself by broadcasting the images, he very well was aware were exclusive property rights of someone else. According to West and Kardashian, Hurley used their proposal to succeed in finding interest in MixBit after a few failed post-YouTube business endeavors.
Hurley's lawyers had appealed a ruling by a Los Angeles judge who apparently refused to dismiss the lawsuit.
Kanye West's elaborate proposal to Kim Kardashian was her 33rd birthday present from the rapper. It took place in October 2013 at San Francisco's AT&T Park. The proposal, which involved the Chicago Symphony, was meant to be the highlight of the upcoming season of "KUWTK."
Kim and Kanye are seeking unspecified damages.
