Comedian Tracy Morgan was injured in a June 7 car accident on the New Jersey Turnpike while he was returning from a standup performance at Dover Downs Hotel & Casino in Delaware.
The "30 Rock" star was released from a rehabilitation center today to finish his recovery at home, days after suing Walmart Stores Inc for negligence, according to Reuters.
Comedian James McNair, who went by Jimmy Mack, was killed in the car accident. Fellow comedian Ardley Fuqua, Jeffrey Millea and his wife Krista are named as plaintiffs in the lawsuit, according to NBC Bay Area.
The Walmart truck driver involved in the car accident, Kevin Roper, has reportedly pleaded not guilty to death by auto and assault by auto charges.
"Based on the investigation we have completed thus far, we feel we have a very strong case against Walmart," Morgan's attorney Benedict P. Morelli said in a statement.
Morelli added, "All the plaintiffs have been seriously injured but the total extent of the permanency of the injuries may not be determined for months or years."
The suit reportedly claims that the truck that Roper was driving was equipped with a "collision-avoidance system" designed to begin to automatically brake before the fatal crash. The lawsuit alleges that Walmart either knew about or should have known about the malfunction equipment before the accident.
"As a result of Wal-mart's gross, reckless, willful, wanton, and intentional conduct, it should be appropriately punished with the imposition of punitive damages," the complaint reads.
