A Georgia man who left his 22-month-old son in a hot car, ultimately leading to the child's death, has been charged with murder, according to BBC News. The child reportedly died of hyperthermia as his body overheated due to outside temperatures of almost 90F.
Including malice murder, a Cobb County grand jury indicted Justin Ross Harris on eight charges related to his son's death including felony murder and cruelty to children, according to NY Daily News.
If convicted, Harris could face the death penalty, according to the Atlanta Journal Constitution.
The indictment also reportedly charges Justin Ross Harris of dissemination of harmful materials to a minor and accuses him of requesting a nude photo from a teenage girl.
Harris' lawyer reportedly stated the death was a "tragic accident" as the father forgot his son was in his vehicle. Harris reportedly told the police he was supposed to drop his son at a nursery but drove to work instead and forgot the toddler was in the backseat.
Harris reportedly took his son to breakfast at a local Chick-fil-A, but still forgot about the toddler's presence in the car, driving directly to his job at Home Deport, where it was found that Harris sexted several women, some of whom were teenagers.
Another investigator testified that the belts on the toddler's car seat were pulled tightly. The boy reportedly had scratches on his face and head, likely to have happened as he frantically tried to free himself from the hot seat, officials stated.
