After Silva announced his retirement to from cage fights, he made a vow never to return again. It can be remembered that he blamed UFC for his decision and told that the low treatment of fighters inside and outside the cage was demeaning.

Silva last went inside the octagon more than a year ago and since then he has been involved with a controversy with the Nevada Athletic Commission. His last fight ended with an epic second-round knockout victory over Brian Stann and he ends his MMA career with a professional record of 35-12-1 with one no-contest.

NAC has already made a decision regarding Silva's case and said that they had banned the UFC fighter for a lifetime coupled with a $70,000 fine.

The case was with regards to when Silva was subject to a random drug screening in Nevada ahead of his scheduled bout with Chael Sonnen at UFC 175, but ran from the testers.

Deputy Attorney General Christopher Eccles recommended to the commission upon Commissioner Pat Lundvall's request that the sanction for Silva should be severe.

But Silva did not accept NAC's ruling and plans to contend the result of the ruling. Silva and his attorney, Ross Goodman, had filed a Motion to Dismiss Nevada's Complaint for Disciplinary Action against him. Their basis would be due to the lack of jurisdiction by the NAC.

NAC confirmed that Silva had not applied for a license to fight in Nevada during the time of testing. According to Goodman "The NSAC (Nevada Athletic Commission) has never been vested with the authority to direct or order non-licensed persons to submit to a chemical test. Consequently, the NSAC lacks jurisdiction to seek disciplinary action against Mr. Silva, and any attempt to do so, clearly exceeds the NSAC's limited statutory jurisdiction."

But NSAC denied the Motion to Dismiss and was still sanction and now, they will fight the commission in court.

Silva said "I'll go to the court. This is not fair, and I'm going to fight to the finish. I'm gonna prove that these guys have no law against me. These guys can't do nothing with me. I'm gonna prove that."

He added ""I don't have a license. I don't work for these guys. I don't have a contract or have nothing signed. What these guys can do? Nothing, and that is their rules. I don't make these rules. These guys make the rules, and these (guys) don't respect their rules. What? These guys want to be over the law?"
