Melissa Rivers has decided to sue the clinic which she blamed for the death of her mom, legendary comic Joan Rivers. But she claimed that the decision wasn't an easy one to make.
In a statement sent to media outlets, Melissa Rivers explained the lawsuit against the New York clinic as she said, "Filing this lawsuit was one of the most difficult decisions I've ever had to make."
The statement added, "What ultimately guided me was my unwavering belief that no family should ever have to go through what my mother, [my son] Cooper and I have been through. The level of medical mismanagement, incompetency, disrespect, and outrageous behavior is shocking and frankly, almost incomprehensible."
"Not only did my mother deserve better, every patient deserves better. It is my goal to make sure that this kind of horrific medical treatment never happens to anyone again."
In an interview with Matt Lauer for the Today show, Melissa Rivers said of Joan Rivers' death, "In my opinion, it was 100 percent preventable."
"How about paying attention to the vital signs? How about having a properly equipped crash cart?" she added.
Joan Rivers died of cardiac arrest "during laryngoscopy and upper gastrointestinal endoscopy with propofol sedation for evaluation of voice changes and gastroesophageal reflux disease."
That means the legendary comic and "Fashion Police" host died from lack of oxygen to the brain.
Joan Rivers died on Sept. 4 after what seemed like a routine endoscopy, which involves inserting a tiny camera to look down her throat. Accordingly the clinic might be liable for allowing her own throat doctor, who was not authorized to practice at the clinic, to examine her as well.
The medical examiner already dismissed foul play as the reason for Joan Rivers' death. That doesn't factor into the lawsuit filed by Melissa Rivers against the New York clinic, however.
Joan Rivers left her $150 million fortune to Melissa Rivers and her grandson.
