"30 Rock" actor Tracy Morgan has filed a lawsuit against Wal-Mart truck driver Kevin Roper, following a fatal car crash that took place in June.

Back then, Morgan was one of the passengers of a limousine bus that was hit by the truck Roper was driving. Multiple sources confirmed that Roper has been sleepless for the past 24 hours prior to the accident, according to Philly.

After being released from rehab, Morgan's representative confirmed the comedian's decision to file a lawsuit against roper and added that Roper was driving way beyond his required speed limit, the same publication noted.

"As a result of Mr. Roper's fatigue, he fell asleep behind the wheel of his truck while he was driving, failed to slow down for traffic ahead and resultantly collided with the limo," the lawsuit filed in the U.S. District Court in New Jersey, Georgia stated.

Following the accident, a Wal-Mart representative expressed their condolences towards those who were involved in the terrible accident, Aceshowbiz reported.

"We know it will take some time to resolve all of the remaining issues as a result of the accident. But we're committed to doing the right thing for all involved."

Meanwhile, Morgan's representative took the opportunity to take Morgan's fans for their support and prayers throughout the past couple of weeks, the Daily Star noted.

Lewis Kay confirmed last Saturday that Morgan will "continue his recovery efforts at home with an aggressive outpatient program. He asked me to pass along his sincerest gratitude to everyone who has helped him get to this point. He would also appreciate some privacy during this crucial point in his recovery."

A photo of Morgan was likewise released by various publications after he was released from rehab on June 13. In the photo, Morgan looked much thinner and was sporting a bandage on his left leg, Aceshowbiz noted.
