Ontario County Police have found "no criminal behaviour" with regards to the racing incident last Saturday that involved Tony Stewart and Kevin Ward Jr.
Stewart first bumped the victim's car and knocked it out. During his next round at the track, Ward climbed out of his car on the track to confront Stewart but then Stewart then struck the driver right after the victim left him car in order to confront him in the dirt track at Canandaigua (N.Y.) Motorsports Park.
Emergency workers were seen rushing to the incident. The track then cancelled the remainder of the sprint slate within five minutes while the Ontario County Sheriff's Department was on site to investigate further but had said that they do not see the situation as a criminal offense.
According to Ontario County Sheriff spokesman Philip Povero "At this time there are no facts that exist that support any criminal behaviour or conduct or that any probable cause of a criminal act in this investigation."
Police said that they had interviewed Stewart as well as other witnesses on the scene and said that they have been cooperative. Povero is still looking for more video footage of the crash to further renhance the investigation. He said "We are seeking persons outside that are familiar with racing that can help us review and analyze these tapes to hopefully fully understand the crash."
Because of the incident, Stewart has not to join the NASCAR Sprint Cup last Sunday in Watkins Glenn, N.Y. NASCAR has been supportive of Stewart's decision saying "We support Tony Stewart's decision to miss today's race, and we will continue to respect the process and timeline of the local authorities and will continue to monitor this situation moving forward."
Race officials have sent out their condolences to the grieving family saying "We at Plymouth Speedway extend our deepest condolences and prayers to the family of Kevin Ward, Jr. and thoughts and prayers to Tony Stewart and his family. Tony Stewart will NOT be racing at Plymouth Speedway this Saturday."
For now, the family of Kevin Ward Jr is still waiting for the results of the investigation.
