"Django Unchained" actress Daniele Watts and her boyfriend Brian Lucas were stopped by cops in Studio City on September 11 after someone called the cops reportedly claiming the couple was having sex in public, according to the NY Daily News.

Daniele Watts and her boyfriend have reportedly been charged with misdemeanor lewd conduct and are due for arraignment November 13, according to a spokesman for the Los Angeles City Attorney.

If the two are convicted, Watts and Brian Lucas could reportedly face a maximum of six months in jail and a fine of $1,000.

"We were sent a collection of evidence from law enforcement and after review, our prosecutors felt filing was appropriate," stated spokesman Frank Mateljan.

When she was arrested last month, the 28-year-old actress reportedly refused to provide identification to the officer, according to the Associated Press. The incident involving Daniele Watts and Brian Lucas received further attention after the actress took to her Facebook page to share her thoughts on the unpleasant exchange.

"I was handcuffed and detained after refusing to agree that I had done something wrong by showing affection, fully clothed, in a public place," wrote Watts on her Facebook page, according to E! News.

Brian Lucas added on his own Facebook page, "I could tell that whoever called on us (including the officers), saw a tatted RAWKer white boy and hot bootie shorted black girl and thought we were a HO (prostitute) & a TRICK (client)."

Author Earl Ofari Hutchinson, who had initially supported the actress, reportedly stated that Watts had "cried wolf."

"We take racial profiling very seriously. It's not a play thing. It's not trivial," he told reporters last month.
