The fact that Kim Hyun Joong's former girlfriend dropped the assault charges against him will not be the end of the case against the singer and "Inspiring Generation" star.
The Songpa Police has announced that they will send the alleged assault case to the prosecutor's office for further review.
The case began on Aug. 20 when a woman claiming to be Kim Hyun Joong's ex-girlfriend filed assault charges against him. Kim Hyun Joong, who was on tour, returned to Korea to meet with the police and during the meeting admitted to his having one physical fight with his ex-girlfriend. He denied any other incidents of physical confrontation.
Kim Hyun Joong's girlfriend then asked for a sincere apology, saying that if she got it she would drop the charges. The singer-actor apologized both publicly and in person.
As part of his public apology he said, "I′m embarrassed at myself for doing something that a man should never do. Since this incident occurred entirely because of my mistakes, there is no reason for her to be blamed. I want to also say sorry to her family and friends. More than anything, I hope she will accept my apology and forgive me. As a result of this incident, I'll work harder to become a better and healthier person."
The ex-girlfriend, speaking through her lawyer, said that she found his apology to be sincere. She withdrew the assault charges on Sept. 17. But that did not end the case.
According to Detective Jung Chae Min at the Songpa Police Department the fact that Kim admitted to one of the assault charges means that the prosecution must investigate.
On Sept. 23 he told Newsen, "Of the four charges reported, Kim Hyun Joong has admitted to the suspicion of injury charge."
When Kim's former girlfriend filed the assault charges, she alleged there were four separate incidents of assault but she only had one set of photographs and a medical report to document injuries that she claimed resulted from one incident.
"We have a medical report on the injuries caused in the one assault he admitted to," said Jung. "Assault cases with physical injuries that are proven cannot be dropped even if there is an agreement between the assailant and the victim."
When was questioned by the police, Kim Hyun Joong admitted that the couple had one physical fight but denied any of the other incidents, including his girlfriend's charges that he fractured her rib in another altercation. He said the injury happened when they were fooling around.
"As he has admitted to it, the case will be forwarded to the public prosecutor′s office either this or next week for further review," said Jung. "We′ll be sending our opinions on the matter and the prosecutor′s office will finalize the case."
It will take about two weeks to prepare the final police statement.
