Tracy Morgan accident update features the "30 Rock" actor's formal filing of his lawsuit against Walmart. The said company is the employer of Kevin Roper, the driver of the trailer truck that crashed into the comedian's limo truck that killed one person and injured several others.
In a report by CNN, the complaint was filed on Thursday, at New Jersey's U.S. District Court.
"As a result of Walmart's gross, reckless, willful, wanton, and intentional conduct, it should be appropriately punished with the imposition of punitive damages," the complaint states.
The Tracy Morgan accident update reveals that the actor/comedian suffered a broken nose, rib, and femur as a result of the crash. The lone fatality was 62-year old fellow comedian James McNair, who goes by the name of "Jimmy Mack."
After a few days of being in critical condition, Tracy Morgan has shown signs of improvement, and was eventually released from the hospital. He is currently undergoing rehabilitation from his injuries.
Meanwhile, the accused Kevin Roper has pleaded not guilty and was released upon posting a $50,000 bail. For the defendant's camp, it was merely exercising their right to do so.
"Mr. Roper has entered a plea of not guilty. It was not an artificial exercise, but rather the first step in defending the charges that have been filed against him," Roper's attorney David Glassman said about the Tracy Morgan accident update. "The initial investigation results released yesterday by the NTSB have only served to bolster our intention to aggressively defend the matter to the fullest."
However, Tracy Morgan's camp is determined to file a case, which they feel is a result of utter negligence on the part of Walmart and Roper.
"The defendants' negligence was a substantial contributing factor in causing plaintiffs' injuries," the complaint reads.
In another report by FOX News, Walmart has yet to make a statement regarding the matter.
